Furlough Extended: What are the rules?

As you may be aware, on Saturday 31st October 2020 the UK government announced that, in light of the new lockdown being introduced in England, the furlough scheme is being extended for a further month and will now end in December 2020. This means that the Job Support Scheme previously announced will be postponed and come into effect once the extended furlough ends.

Private investment is the answer

First the bad news. We stand at the beginning of a brutal economic crisis of truly historical proportions. Many businesses will fail and employees lose their jobs. Economic, social and quality of life issues loom. Much of this pain may be unavoidable.

But do not despair. There is a solution. There is a lot more that government and the business community can do to ease the pain. Investors have capital they are willing to invest in the SME space.

FURLOUGH SCHEME: ERRORS AND PENALTIES

HMRC has published new guidance on what to do if you have made an error in a claim under the furlough scheme and claimed too much or too little. There is also new guidance on penalties which apply in cases of overpayment.

If an employer has claimed too little for an employee under the scheme, they can inform HMRC and amend the claim. However, since 31st July 2020 claims cannot be amended for the period up to 30th June 2020 where an employee should have been included in a claim before that date. However, the guidance indicates that other errors can still be rectified. The guidance also confirms that where too little has been claimed in error, the employer must pay the employee what they were due and make up any shortfall. Read more…

ENFORCING A CCJ IN SCOTLAND

As you might expect, we are seeing an increase in debt recovery queries owing to the current circumstances. It’s worth noting that although the process isn’t operating as normal, CCJs can still be enforced, particularly if urgent.

If you, or your client, has obtained a County Court Judgement (CCJ) against a Scottish debtor we are able to assist you in registering that CCJ in Scotland to enable enforcement proceedings to commence.

Methods of enforcement include: earnings arrestment; winding-up/insolvency proceedings; attachment (seizure of certain goods); arrestment (of monies held in bank or with third parties); and inhibition (an order preventing sale of heritable property). Read the full blog here.
