Erki Kergandberg and Elmer Muna comment on charges brought against Liviko in the business daily Äripäev

This spring, the Office of the Prosecutor General brought charges against several retailers and alcohol producer Liviko, accusing them of concluding an agreement with competitors on the increase of the retail prices of certain brands of vodka in 2009. The defence counsel of Liviko, TARK GRUNTE SUTKIENE partner Erki Kergandberg noted in court that he understood the charges in grammatical terms but Liviko did not plead guilty. Mr Kergandberg added that the charges brought by the prosecutor were groundless and Liviko had neither concluded any agreement with any competitor nor engaged in concerted practices. The defence attorney for the supermarket chain Selver, TARK GRUNTE SUTKIENE senior associate Elmer Muna, said that the charges were vague and there was no evidence. He added that Liviko and Selver as members of the same group were allowed to discuss matters between themselves. “In my opinion the charges are unfounded”, Mr Muna said.

TARK GRUNTE SUTKIENE advised on the sale of the office building of Flora in Tallinn at Tulika street. This building has a long and distinguished history; it has accommodated a great number of successful small and medium-sized businesses. The gross leasable area of the building is 4,400 square metres, and the new owners are Lumi Capital and Estonian private investors. The parties have agreed not to disclose the cost of the deal. AS Flora will continue the management of Flora Kaubanduse and other properties owned by Flora.

Eesti Päevaleht daily: Elmer Muna comments on redistribution of public funds for treatment

Since February this year, private clinics in Estonia have been ringing the alarm bells about the resolution of the management board of the Estonian Health Insurance Fund whereby some private clinics were deprived of the opportunity to compete for funding awarded by the Health Insurance Fund in the same extent as in previous years.

Private clinics have said that they will not stop before bringing the dispute before the Supreme Court. “At the same time next year we will most likely have the final judgment,” Elmer Muna, the representative of Nova Vita and Fertilitas clinics, estimated. Nova Vita, for example, has applied for interim relief for the time when the dispute is pending, requesting that a competition should still be held for the funds for infertility treatment awarded to West-Tallinn and East-Tallinn Central Hospitals so that Nova Vita could compete for those funds.
