ARGENTINA – CLIENT ALERT SUSPENSION OF DISMISSAL WITHOUT CAUSE AND FOR REASONS OF FORCE MAJEURE

On March 31, 2020, the Decree of Necessity and Urgency No. 329/2020 was published in the Official Gazette, which prohibits dismissals without just cause and on the grounds of lack or reduction of work and force majeure for a period of 60 days from the date of its publication (that is, May 30, 2020).

Likewise, said decree prohibits suspensions for reasons of force majeure or lack or reduction of work for a period of 60 days from the date of its publication.

O Governo Federal publicou, em edição extra do Diário Oficial, medida provisória, com diversas medidas com a finalidade de preservar o emprego e a renda de trabalhadores durante o período de calamidade pública reconhecido pelo Decreto Legislativo nº 6, de 20 de março de 2020, tratando, principalmente, de teletrabalho, antecipação de férias individuais, concessão de férias coletivas, aproveitamento e antecipação de feriados, banco de horas, suspensão de exigências administrativas em segurança e saúde no trabalho, direcionamento do trabalhador para qualificação e o diferimento do recolhimento do FGTS.
