“Existence Of A Dispute” Under The Insolvency And Bankruptcy Code Clarified By The NCLAT

The issue concerning conflicting interpretations of the phrase “existence of a dispute” under the Insolvency & Bankruptcy Code, 2016 (“Code”) by the Delhi and Mumbai benches of the National Company Law Tribunal (“Tribunal”) (see One Coat Plaster vs. Ambience Pvt. Ltd., Annapurna Infrastructure Pvt. Ltd. & Ors. vs. Soril Infra Resources Ltd. and Essar Projects India Ltd. vs. MCL Global Steel Pvt. Ltd.), seems to have been put to rest by the National Company Law Appellate Tribunal (“Appellate Tribunal”) for the time being.

Insolvency and Bankruptcy Code – Meaning of “Dispute In Existence”

The recently implemented Insolvency & Bankruptcy Code, 2016 (“Code”), which streamlines the insolvency and liquidation process in India, has lately become the subject of varying interpretations by the National Company Law Tribunal (“Tribunal”).

Conflicting interpretations as to what constitutes a “dispute in existence” have surfaced between the Delhi and the Mumbai benches of the Tribunal.

Things you need to know about Employment and Business Visa in India

 

General Requirements

The Foreigner’s Act, 1946, The Registration of Foreigners Act, 1939 and The Citizenship Act, 1955, together with allied rules and periodic amendments regulate the foreigner’s entry, along with the immigration policy, movement and stay in India. Most foreign nationals entering India require a valid passport along with an appropriate visa depending on the motive of visit to India. Visa can be issued for the following purposes.

Business Visa: An individual seeking to travel to India on business should obtain a Business Visa. The validity of a business visa can range from 6 months to 10 years. Individuals who seek to establish a business in India may be eligible for a business visa, which is usually issued with a longer validity period (a long term visa). A business visa application should include supporting documents from the sponsoring organization(s).

Mumbai gets favorable order from Bombay High Court

The deal was relating to an Agency agreement between an Indian agent and our client, a foreign principal. The Agency Agreement was for supply of certain material by our client against a Government Tender. The Agreement was for a period of 10 years.

Our client terminated the Agreement by giving due notice. The Indian agent filed civil suit for declaration stating that the Agreement was wrongly terminated and he continues to be the agent.
