Arnstein & Lehr Chicago Partner Samuel H. Levine was interviewed by the Illinois Bar Journal and quoted in their November issue in an article titled “Debate continues over controversial mechanics lien bill.” The article discusses the legislative efforts to overturn a recent Illinois Supreme Court case, LaSalle Bank National Association v. Cypress Creek, regarding the priority status between mortgagees and mechanics lien claimants when there are insufficient proceeds from a foreclosure sale. Mr. Levine comments that the Supreme Court held that section 16 of the Mechanics Lien Act gave mechanics lien claimants priority only with respect to the value of the property attributable to improvements for which they furnished material or services, rather than with respect to all improvements made subsequent to the mortgage.
