Lidings Runs Fall International Internship Program for its Lawyers: Sweden 2017
idings starts its annual International Internship Program traditionally organized for the firm’s lawyers during the year and is delighted to announce that Senior Associate in the firm’s Intellectual Property practice Boris Malakhov has enrolled the Fall Program taking place in Sweden. Boris will undergo a four weeks internship in one of the largest international law firms Magnusson.

Amendments are planned to the Government Resolution of the Russian Federation No. 1342 dated 08.12.2015 on compliance with waste recycling standards reporting procedure
The Ministry of Natural Resources and Ecology of the Russian Federation has developed the draft of the Government Resolution “On amending the Government Resolution No. 1342 dated 08.12.2015” (hereinafter- “Resolution”) dedicated to the compliance with waste recycling standards reporting procedure.
The main amendments are as follow:
- The list of goods which are covered by the Rules approved by the Government Resolution of the Russian Federation No. 1342 dated 08.12.2015 (hereinafter – “Rules”) is stipulated. The moment when the obligation to submit report is clarified

Moscow Region Commercial Court rendered a precedent decision in an originator-generic dispute
On September 27, 2017, the Moscow Region Commercial Court published a significant decision in a patent dispute between Novartis AG, Swiss originator, and Nativa LLC, Russian generic producer (case No. A41-85807/2016).
Under the auspices of the case, Novartis AG filed a patent infringement lawsuit against Nativa LLC claiming that its active patent on «Tyrosine kinase inhibitors» (No. 2348627) is used both in the “original” drug “Tasigna” and “generic” drug “Nilotinib-native”1, while registration of the “generic” drug before the Ministry of Health threatens to violate the patent.

The order for the formation of VED prices was clarified to wholesale and retail organizations on general tax system
The Russian Federal Antimonopoly Service (FAS Russia) clarified the order for the vital and essential drugs’ (VED) prices assessment for VAT payers in its letter No. АК/46404/17 dated 07.07.2017 “On consideration of application letter”.
Statutory rules of VED selling do not consider that the medical drugs’ sellers apply different tax systems: general and simplified.
As a result, the wholesale organizations on general tax system charge VAT directly on retail price (over wholesale bidding), which influences on the final drugs price.

Procedure for information disclosure to companies’ shareholders has changed
On July 30, 2017 the Federal law No. 233-FZ dated 29.07.2017 “On amendments to the Federal law “On joint stock companies” and article 50 of the Federal law “On limited liability companies” (hereinafter — “233-FZ”) entered into force, that amended the procedure for providing information by joint stock companies and limited liability companies to the owners of their shares.
In joint stock companies the following information is now available only to shareholders owning at least 1 % of the shares:
- information about major transactions and interested party transactions;
- minutes of the board of directors meetings;
- appraisers’ reports on property valuation in respect of which major transactions and interested party transactions took place.

Review of the joint informational Letter of the Ministry of natural resources and environment of the Russian Federation and Rosprirodnadzor on licensing of activities on waste management
The Ministry of natural resources and environment of the Russian Federation in the Letter dated 13.04.2017 No. АС-10-01-36/7619 (hereinafter – the “Letter”) clarifies a number of issues concerning licensing of activities on management of wastes included in I – IV hazard classes.
The key conclusions of the Ministry of natural resources and environment of the Russian Federation are outlined below:
- Waste collection is the initial stage of waste management and is aimed at securing any of the subsequent methods of waste management. In this regard, waste reception or arrival from individuals and legal entities for subsequent implementation in relation to such waste of at least one of the waste management activities (treatment, recycling, neutralization, transportation and disposal) is considered to be collection of waste.

Lidings Becomes the First Law Firm in Russia to Ensure Establishment of a New Type of NCO in the Country
Lidings announces the completion of a large-scale project on comprehensive legal support of establishing a new type of non-commercial organizations (NCO) in Russia created to ensure substantive implementation of waste recycling standards by its members – tyre producing companies and consumer electronics and computer equipment manufacturers and traders. Both NCOs were established upon request of the firm’s clients – the Tyre Manufacturers Association (TMA) and the Association of Trading Companies and Manufacturers of Electrical Household and Computer Equipment (RATEK).
As TMA’s and RATEK’s legal advisor, Lidings’ corporate and M&A practice group headed by firm’s partner Sergey Patrakeev ensured the establishment of the two unions created specifically in order for its members (member-companies of TMA and RATEK) to comply with waste recycling standards according to the Federal Law 89-FZ from 24.06.1998 «On production and consumption wastes», taking into account the changes introduced into it by 458-FZ with regard to the requirements for the implementation of waste recycling standards and environmental fee payments.
