California Consumer Privacy Act Amendment Signed into Law

On September 23, 2018, California’s Governor Jerry Brown announced that he signed SB 1121 into law. SB 1121 modifies the California Consumer Privacy Act of 2018 (the “Act”), which was passed earlier this year (discussed in a September 2018 alert). SB 1121 leaves the Act largely intact, but it does clarify certain aspects of the Act, as briefly discussed below.

Community Bank Regulatory Relief: Exam Cycle and Small Holding Companies

In August 2018, the federal banking agencies issued two interim rules implementing provisions of the Economic Growth, Regulatory Relief, and Consumer Protection Act of 2018 (EGRRCPA) intended to reduce regulatory burdens on banks, thrifts, and their holding companies. On August 23, the federal banking agencies issued joint interim final rules allowing qualifying insured depository institutions with under $3.0 billion in total assets to benefit from an extended 18-month examination schedule in place of the former 12-month schedule. And on August 28, the Federal Reserve issued an interim final rule expanding the applicability of its small bank holding company policy statement to bank holding companies and savings and loan holding companies with consolidated assets of up to $3.0 billion.

Federal Court Clarifies the Scope of Drawings in a Design Patent

Design patent filings have increased dramatically in recent years, as companies gain appreciation for the ability of these patents to prevent counterfeits and grey market imports. With the higher volume of patent filings comes a higher volume of legal disputes. In one such dispute, the Federal Circuit held that a design patent application that uses two-dimensional drawings to describe a three-dimensional product may be acceptable under patent law.

Missouri Voters Kill Right-to-Work Law Signed into Law By Former Governor Greitens

On August 7, 2018, Missouri voters officially decided that Missouri will not join the majority of other states around the country to become a “right-to-work” (RTW) state. The controversial RTW issue, which Lewis Rice previously reported on here and here, emerged from a prolonged legislative process, only to be later overturned through Missouri’s rarely-invoked referendum process.

Missouri Supreme Court Decision in Talc Case Could Herald Change in Where Mass Tort Litigation May Be Filed

On March 6, 2018, the Missouri Supreme Court declined to review the October 17, 2017 decision by Missouri’s Eastern District Court of Appeals in Fox v. Johnson & Johnson, which had overturned the trial court’s $72-million talc verdict against the defendant. The Eastern District found that the trial court lacked personal jurisdiction over Johnson & Johnson for the claims filed by Jacqueline Fox. The decision by Missouri’s highest court, which concerned the first of five major talc verdicts entered against Johnson & Johnson, not only clears the way for Johnson & Johnson’s success in the pending appeals of three other multimillion-dollar verdicts issued by St. Louis City jurors and supports a California trial judge’s October 2017 decision to vacate a fifth $417 million verdict, but could herald a fundamental change in how mass tort cases may be litigated.

Union “Salting” Protections in the National Labor Relations Act Affirmed by Eighth Circuit

On February 21, 2018, the U.S. Court of Appeals for the Eighth Circuit issued an opinion upholding protections for union “salting” campaigns under the National Labor Relations Act (NLRA). A “salting” campaign involves union members’ recruiting potential members by applying for and accepting jobs at non-union work sites. In Aerotek Inc. v. National Labor Relations Board, four organizers of the International Brotherhood of Electrical Workers Union (IBEW) applied for placement with Aerotek, Inc., a nationwide staffing agency based out of Omaha, Nebraska. The organizers planned to recruit members from Aerotek’s non-union job sites. Aerotek ignored and ultimately did not place any of the organizers. Upholding the decision of the Administrative Law Judge (ALJ), the National Labor Relations Board (NLRB) determined that Aerotek’s refusal to place the union organizers violated the NLRA.
