Davis Malm attorney Michael D. Weisman has been reappointed a Clinical Visiting Lecturer in Law at Yale Law School. This is the second year Mr. Weisman, a trial lawyer at Davis Malm, will be on the faculty at Yale Law School. A champion of under-served public school children and best known for his seminal case McDuffy v. Secretary that held that the Commonwealth of Massachusetts had a constitutionally-enforceable duty to provide all public school students with a quality education, Mr. Weisman is eminently qualified to co-teach in Yale’s Education Adequacy Project, a unique clinical program in which Yale law students serve as counsel to the plaintiffs in a challenge to the constitutionality of Connecticut’s public school system.

On April 26, Davis Malm attorney Laurie Alexander-Krom participated in a Northeast Human Resources Association (NEHRA) Technology Forum on the new Massachusetts data security regulations. Ms. Alexander-Krom provided an overview of the regulations and discussed what Massachusetts businesses must do to comply. Ms. Alexander-Krom was joined by Doug DeMio, Manager of IT Security at Neighborhood Health Plan, who discussed the new regulations’ technical requirements.

On Tuesday, April 6, Davis Malm attorneys William F. Griffin, Jr. and Sophie C. Migliazzo served as Faculty Members in a Massachusetts Continuing Legal Education seminar, “A Practical Guide to Business Acquisition Agreements.” This seminar provided an overview of the business acquisition process and is designed for attorneys seeking to improve their practical skills in drafting, negotiating, and closing business acquisition agreements. Mr. Griffin served as chair of the seminar and shared knowledge from his years of experience representing business clients in a variety of business acquisitions. He described the business acquisition process from inception (the seller’s decision to put the company up for sale) to closing the deal, emphasizing practical negotiating strategies. Ms. Migliazzo served as a faculty member and discussed trends in specific provisions of acquisition agreements, such as caps, baskets, material adverse change clauses, and various representations and warranties.

On April 6, Davis Malm attorney Rebecca L. Andrews participated in the Women’s Bar Association Law Student Committee’s annual event, “What They Didn’t Teach You in Law School.” The event featured a variety of current practicing female attorneys – including judges, mediators, government attorneys, solo practitioners, and private practice attorneys – discussing their choice of career paths and their diverse experiences. The program was structured in a speed-networking format, allowing students helpful one-on-one time with the practicing attorneys. As in past years, the event provided the students with invaluable insight into the “ins and outs” of certain career paths and the actuality of practicing law day-to-day. Ms. Andrews focussed her discussions on her experiences as a litigator and practicing law at a private practice firm.

On March 11, Davis Malm attorney James E. Gallagher acted as a mock trial judge at the Boston Regional National Appellate Advocacy Competition sponsored by the American Bar Association’s Law Student Division. Student competitors participated in a hypothetical appeal to the United States Supreme Court, which required them to write a brief, as either respondent or petitioner, then argue their case in front of the mock court. Mr. Gallagher judged oral arguments of four teams. The NAAC is one of the largest moot court competitions in the country and emphasizes the development of oral advocacy skills through a realistic appellate advocacy experience. This year’s competition was the largest in its history, with 198 teams from 119 schools throughout 15 states competing.

On March 22, Davis Malm attorney David Rapaport spoke on a panel with Justice Giles of the Massachusetts Superior Court, along with other experience trial lawyers, at a Boston Bar Association program titled “Is the Civil Justice System in Need of Serious Repair: Part II.” The program focused on the Final Report of the American College of Trial Lawyers Task Force on Discovery, which recommended significant changes to the rules of discovery in civil cases, and the basis for its conclusions, as well as two of the more controversial recommendations. Mr. Rapaport discussed problems presented by the proposed new rules for employment plaintiffs who need full and fair discovery in order to prove their cases.

On February 11, Davis Malm attorney David M. Cogliano conducted an employment law program, “2010 Legal Update,” for the Smaller Business Association of New England in Waltham, Massachusetts. David was joined by two other employment attorneys on the panel. The interactive program provided a comprehensive overview of the many employment law changes that came about in 2009 that directly impact employers and their HR practices and the consequences of non-compliance. Specific topics included: the importance of properly classifying workers; utilizing non-compete, non-solicitation and confidentiality agreements; changes to the Americans with Disabilities Act; the use of social media in the workplace; the duty to accommodate persons with disabilities; and the Employee Free Choice Act.
