Private companies face public conundrum under new crowdfunding rules

A sticking point from the Federal Government’s Corporations Amendment (Crowd-sourced Funding) Act 2017 , was that there was no scope for private (proprietary limited) companies to access crowdfunding. Government sought to address this in the latest Federal budget, but there could be a catch.

The Crowdfunding bill passed in March, and becomes law this September. Feedback suggested few start-ups would consider crowdfunding under the model due to private companies being unable to raise money from the public and access the new regime, and the compliance burden of trading as a public company.

Employers and franchisors take note – are you compliant?

The exploitation of vulnerable workers dominated headlines for much of 2016. As a result of the widespread issues identified, the Turnbull Government promised to strengthen laws to protect those most vulnerable to workplace exploitation.

In fulfilling this promise, the Government has introduced the Fair Work Amendment (Protecting Vulnerable Workers) Bill 2017 (Cth) (Bill). The Bill proposes a raft of changes to the Fair Work Act 2009 (Cth) (Act) to among other things, increase penalties for certain breaches of the Act, strengthen the powers of the Fair Work Ombudsman (FWO) and to hold franchisors accountable for the actions of their franchisees.

New legislation to criminalise corrupting benefits between employers and unions

On 22 March 2017, Prime Minister Malcolm Turnbull introduced legislation to criminalise the giving, receiving or soliciting of ‘corrupting benefits’ between employers and trade unions.

The Fair Work Amendment (Corrupting Benefits) Bill 2017 (Bill) was introduced in response to recommendations of the Final Report of the Royal Commission into Trade Union Governance and Corruption, to promote better governance of registered organisations.
