Arnstein & Lehr Chicago Partner David Sugar testified on January 8, 2013 before the City of Chicago Committee on Housing and Real Estate in support of proposed amendments to the Chicago Condominium Ordinance introduced by Alderman Thomas M. Tunney. Among other things, the proposed amendments would impose a 10 year limit on the number of years of financial records subject to inspection by a condominium owner, and would also expand the time allowed for condominium associations to make requested financial records available for inspection from 10 business days to 30 business days. Mr. Sugar’s testimony addressed the need to make the existing Ordinance more fair and reasonable, and to bring the Ordinance more into line with the record inspection provisions of the Illinois Condominium Property Act. Mr. Sugar also responded to questions from various aldermen concerning the City of Chicago’s home rule primacy on condominium regulation, and on private rights of action for violations of the Ordinance.
