Tribunal : Law Society of Ontario Failed in its Duty to Accommodate Lawyer

In a recent decision of the Law Society Tribunal (“Tribunal”),-  Law Society of Ontario v. Burtt, 2018 ONLSTH 63 – panelist Larry Banack dismissed an application by the Law Society of Ontario (“LSO”) seeking a finding that one of its lawyer  licensees had committed professional misconduct.  Mr. Banack found that the lawyer’s alleged misconduct, i.e. his failure to cooperate with a Law Society investigation was the direct result of a disability and that the Law Society had not discharged its legal obligation to accommodate the lawyer’s disability to the point of undue hardship.

False or Misleading Exemption – Decision to deny discretionary exemption set aside

The first defendant alleged he sustained injuries in a motor vehicle accident on 24 April 2013 including a back injury. The first defendant was assessed by a number of medical professionals, including medico-legal doctors organised both by his lawyers and the insurer, treatment providers and independent medical assessors appointed by the Medical Assessment Service (MAS). To those doctors, and also in his personal injury claim form and a statement prepared for the purposes of his CARS application, he indicated he had no previous injuries to similar parts of his body.

Craig D. Levey to Moderate MBA Program

On March 15, Davis Malm attorney Craig D. Levey will moderate the Massachusetts Bar Association (MBA) Legal Lunch Program, “Feed Your Mind: Massachusetts Appellate Practice and Procedure.” The session will cover how judges prepare for argument and how appellate panels decide the cases before them, as well as briefings, oral arguments, and amicus briefs. The discussion will also feature two guest speakers from the Massachusetts Appeals Court: The Honorable William J. Meade and Joseph F. Stanton, Esq.
