Connolly Gallagher Commercial Bankruptcy Partner Jeffrey Wisler presented at the American Bankruptcy Institute’s Rocky Mountain Bankruptcy Conference on best practices for Section 363 sales. Alongside co-presenters from Denver and Salt Lake City, Jeff discussed recent venue developments and cases, including In re LTL Management LLC, Case No. 21-30589 (Bankr. W.D.N.C.) and In re The Aliera Companies Inc., Case No. 21-11548 (Bankr. D. Del.). Jeff also discussed recent rule changes and proposed legislation that may impact jurisdictions that have proven to be popular choices for large, commercial chapter 11 cases. For example, the Southern District of New York and the Eastern District of Virginia recently implemented new rules to randomize judge assignments in Mega Chapter 11 Cases (S.D.N.Y.) and matters with assets or liabilities greater than $1,000,000 (E.D. Va.). Likewise, the proposed Bankruptcy Venue Reform Act of 2021, could have an even greater impact by substantively amending Sections 1408 and 1412 of Title 28 of the U.S. Code.
U.S. Attorney David C. Weiss recently announced a settlement with Hunt Companies, Inc., one of the nation’s largest providers of privatized military housing. The settlement of $500,000 resolves fraud allegations arising from Hunt’s submissions of materially false information about the condition of private military housing at Dover Air Force Base between January 2013 and June 2019. It was alleged that the false information caused Hunt to receive larger performance incentive payouts from the U.S. Government.
Alan R. Silverstein has joined the firm as a Partner in the Intellectual Property Litigation and Delaware Business, Commercial, and Corporate Litigation practice groups. Alan has extensive experience in commercial and complex litigation, with a focus on patent litigation, trademark litigation, and trade secret litigation. In addition, he has regularly represented clients in contract disputes and business tort matters in both Delaware and federal courts. He is experienced with all phases of litigation including large-scale electronic discovery and managing scientific experts. Alan earned his J.D. from Temple University Beasley School of Law and a bachelor of science from Ursinus College. Alan is a member of the American Intellectual Property Law Association and the Richard K. Herrmann Technology American Inn of Court.
