Sufficient evidence of a credible acquisition required for input tax credits
In Sunlea Enterprises Pty Ltd As Trustee for Drummond Cove Unit Trust and FCT [2018] AATA 2792, the Administrative Appeals Tribunal (AAT) decided that the trustee of a unit trust was not entitled to input tax credits as there was insufficient evidence of a creditable acquisition and the relevant invoices did not comply with the requirements of a tax invoice for GST purposes. This case illustrates the importance of proper documentation to ensure that you are able to substantiate and claim the relevant tax credits.

Google’s Investment in Medicare Advantage Solidifies its Staying Power
On August 14, 2018, Oscar Health announced that Google-parent Alphabet will invest $375 million into its expansion into the Medicare Advantage Health Plan Market. Unlike its larger and more established health insurance counterparts, Oscar Health, a New York startup, was created to capitalize on the expansion of individual insurance coverage under the Affordable Care Act (“ACA”). Oscar Health uses technological interfaces, data, and telemedicine to help improve the patient experience. Despite constant political attacks on the ACA, Oscar Health is gradually moving into more state markets as larger players are leaving the individual health insurance market. In 2018, Oscar Health filed insurance applications in six new state insurance markets.
New IRS guidance aligns solar “start of construction” with standard for wind
Since its inception in 2006, the investment tax credit for solar energy development has played a critical role in the solar power industry’s meteoric rise. In sixteen short months, though, we enter the phase-down period, wherein the ITC will drop incrementally from its current 30 percent (through 2019) to a permanent 10 percent (after 2022). As equipment prices have plunged and market penetration has soared, the solar power industry will undoubtedly continue to expand without the full benefit of the ITC as it stands today.

Thought there was no annual leave entitlements for casuals? Think again
In a case likely to ring alarm bells for employers, the Full Court of the Federal Court was required to determine in WorkPac Pty Ltd v Skene [2018]1 whether an employee of a labour hire company who the employer claimed was engaged and paid as a casual was entitled to annual leave entitlements under section 86 of the Fair Work Act 2009 (FW Act) upon the termination of his employment.
