On June 01, 2016 Chapter 29.1 of the Arbitrazh Procedure Code (hereinafter – “the APC RF) named “Summary proceedings” comes into effect1.
A Writ («Sudebny Prikaz» or «court order») is issued for the recovery of money in the following cases: (Article 229. 2 of the APC RF):
- under claims arising out of or in connection with the contract that are recognized but not performed by the Defendant and amount to not more than 400 000 rubles.
- under claims arising out of or in connection with the notarial protest of the bill that amount do not exceed 400 000 rubles.
- under claims on compulsory payments and penalties that amount not more 100 000 rubles.
