Canadian Court Orders Google to Scrub Its Search Results

desktopThe internet’s sheer breadth often gives the impression that it transcends local legal jurisdictions. As commerce and trade become increasingly electronic ventures, courts now grapple with how to enforce orders against parties not operating within traditional physical jurisdictions.

In June, the British Columbia Court of Appeal (the “Court”) in Equustek Solutions Inc. v. Google Inc., 2015 BCCA 265, upheld a decision granting an injunction ordering Google to de-index from its search results certain websites selling goods subject to an intellectual property infringement claim.

The new Inheritance Tax Residence Nil Rate Band

The Summer Budget Finance Bill (the Finance (No. 2) Bill 2015) has now been published and it contains the draft legislation to implement the new Inheritance Tax (IHT) Residence Nil Rate Band (RNRB).  So let’s take a look at the detail of what’s involved.
The RNRB can only apply in full if a person’s estate on death is £2 million or less.  This figure is the ‘taper threshold’.  The taper threshold will increase in line with the Consumer Prices Index (CPI) after tax year 2020/2021.  The RNRB is reduced by £1 for every £2 that the estate exceeds the taper threshold.  
A ‘person’s estate’ is defined in section 5 of the Inheritance Tax Act 1984 (IHTA 1984); essentially it is all the property to which a person is beneficially entitled the moment before death, less deductible liabilities.  This definition includes property subject to a reservation of benefit for IHT purposes and a qualifying/estate interest in possession but does not include other types of interest in possession and excluded property. 
The RNRB will first come into effect in tax year 2017/2018, increasing with each tax year thereafter.  It is calculated with reference to the ‘residential enhancement’, as follows:

Multistate Tax Update — July 23, 2015

Last week, the Cook County commissioners raised the county sales tax by 1 percent, from 0.75 percent to 1.75 percent, in a 9-7 vote, NBCChicago reported. The board president blamed state lawmakers who failed to approve a pension reform plan that has been stalled for nearly two years. As it currently stands, she asserted, the county’s pension fund is $6.5 billion short of its obligation to retired workers, and the debt continues to grow at a rate of $1 million a day. In addition, the increase bumps Chicago’s total sales tax from 9.25 percent to 10.25 percent, making it the highest sales tax rate in the country.
