Regular overtime counted towards High Income Threshold

The Full Bench of the Fair Work Commission (FWC) has held that income earned from regular overtime can count towards the calculation of the high income threshold for unfair dismissal applications.

Under the Fair Work Act 2009 (Cth) an employee is jurisdictionally barred from making an unfair dismissal application if they earn over the high income threshold which is currently $129,300 per annum and they are not covered by a modern award or enterprise agreement. More…
