Some mutual funds (and possibly other funds) that are made available by a 401k plan for investment by its participants may make payments to the plan’s record-keeper (and perhaps other service providers) for certain services in connection with the plan’s investment. Advisory Opinion 2013-03A (“Opinion”), which was issued by the U.S. Department of Labor (“DOL”) on July 3, 2013, addresses whether certain payments of this type might be deemed “plan assets” under the Employee Retirement Income Security Act (“ERISA”). Significantly, the DOL also points out obligations of plan sponsors and committees (and any other fiduciary responsible for making payment decisions) in choosing to approve and to continue such arrangements, since failure to do so could result in liability to these fiduciaries.

Haze Plan Ruling Leaves States at EPA’s mercy.” The article, published on July 22, discusses a decision by the Tenth Circuit to back the Environmental Protection Agency’s power to reject Oklahoma’s emissions control plan for haze-causing pollution. Mr. Anaya offers his thoughts on the challenges still facing the court.

Arnstein & Lehr Miami Partner Ronald R. Fieldstone and Associate Anthony Kang were recently interviewed for a segment with the China Business Network regarding foreign investments in Miami. The segment focused on foreign investments in Miami and what attracts investors to South Florida. The segment opens with the notion that the Miami Heat helped the city gain visibility to foreigners who otherwise would not necessarily think to come to Miami to invest. Mr. Kang discussed the different types of investors that come here (typically high net-worth individuals/entities). Mr. Fieldstone discussed EB-5 investment opportunities.

The Senate also confirmed current NLRB Chairman Mark Gaston Pearce (D).

On July 23, Florida Governor Rick Scott signed House Bill 85, relating to public-private partnership, alongside one of the bill’s sponsors, Arnstein & Lehr Miami Partner and State Senator Miguel Diaz de la Portilla. HB 85 relates to the public-private partnership to help streamline the process to create private investment opportunities toward public projects. It also created a commission that establishes consistent guidelines for public private partnership selection and review procedures. In addition, it outlines financing provision to allow public entities to lend funds to private enterprises and to use federal loans and commercial loans. “Governor Scott’s mission is to create a job for every Floridian who wants one. Our public-private partnership legislation will create even more job opportunities for families in Miami-Dade and all across Florida,” said Miguel at the signing.
