Arnstein & Lehr Chicago Partner Michael L. Gesas and Associate Kevin H. Morse authored an article titled “The Disappearing Act of Ch. 11 Business Cases” that appeared in the March 29 edition of Law360. In the article, they speculate that with the current sluggish economic growth not increasing bankruptcy filings, it is possible that traditional Chapter 11 bankruptcy cases may have become a “relic of the past,” heralding an era of liquidation, prepackaged short-term bankruptcies and Section 363 sales followed by a dismissal of the pending chapter case.
